While ABPM has used all reasonable efforts in good faith to provide accurate and up to date information, and accurately cost the collection and processing of Biological Product(s). ABPM reserves the right to review its collection, processing and quality assurance testing procedures, special conditions. treatments and analyses which it may provide on request ,and make adjustments to prices without notice.
ABPM,its affiliates and officers, directors, employees and agents :-
i) make no representations or warranties of any kind, either express or implied, in respect to the collection, processing or the supply of the Biological Product(s) as the their availability,merchantability,quality, fitness for a particular purpose, cost or otherwise for which they are being provided, or that the collection, processing, supply of the Biological Product(s) will not infringe or violate any patent or proprietary rights of third parties; and
ii) shall not be liable for any errors or omissions, loss of profits, loss of business or other consequential, special, indirect or punitive damages resulting from the use of, or reliance on the information contained in the Price List except to the extent such damage results directly from ABPM’s gross negligence or willful conduct. ABPM’s liability resulting from anything contained in the Price List is limited to an amount equal to the payments received from the recipient for the collection, processing and supply of Biological Product
